Free Trial Agreement

By submitting this form and selecting “I Agree,” you (“Customer”) acknowledge and agree that Pro Stat LLC d/b/a StatGun USA (“Company”) grants you permission to use the StatGun equipment (“Equipment”) on a free trial basis beginning upon receipt of the Equipment and continuing for the designated Free Trial Term; you agree to provide valid credit card or ACH information and authorize Company to place a temporary $1.00 authorization charge for verification purposes and further authorize Company to charge the full replacement cost of $2,700.00 in the event of destruction, abuse, loss, theft, or failure to timely return the Equipment; at the conclusion of the Free Trial Term you agree that within seven (7) days you will either return the Equipment using a trackable shipping method at your expense, purchase the Equipment, execute a Service Plan Agreement, or execute a Quantum RO Billing Agreement, and if no action is taken Company may charge $200.00 plus applicable taxes per month for continued use on a non-contractual, month-to-month basis, which charges are non-refundable; you remain responsible for the Equipment until received by Company; you acknowledge that the payment authorization provided is voluntary and expressly authorizes all charges permitted under this Agreement, and you agree not to initiate any chargeback, payment dispute, or reversal for charges properly incurred under the terms of this Agreement, including but not limited to monthly usage charges or replacement cost charges, and any chargeback or payment dispute initiated in contradiction to this Agreement shall constitute a material breach of contract, and you agree to reimburse Company for any resulting fees, administrative costs, collection expenses, and reasonable attorney’s fees incurred in recovering such amounts; you may not reverse engineer, modify, sublease, or transfer the Equipment; the Equipment is provided “as is,” Company disclaims all express or implied warranties, Company shall not be liable for indirect, incidental, consequential, or punitive damages, Company’s aggregate liability shall not exceed $100.00, and this Agreement shall be governed by the laws of the State of Florida, with electronic acceptance constituting a legally binding signature.
